Should I Call an Attorney if a Loved One Goes into a Skilled Nursing Facility?

What do you do if a spouse or parent goes into the nursing home out of the blue? No advance notice—you didn’t see it coming and all of a sudden you have a loved one in a skilled nursing home. The first thing you want to do is call a certified elder law attorney. 

The nursing home will not give you proper advice on how to preserve as much of your estate as possible. I can tell you that if your spouse goes into the nursing home and you see me, there is a very significant likelihood we can preserve all of your estate—that you will pay very little, if anything, to the nursing home before qualifying for Medicaid benefits. 

The nursing home will not tell you that. However, I will tell you that and I will explain to you how you do that. 

Even if a parent goes into a nursing home, there are Medicaid crisis plans that are available that are legitimate, that are approved by the courts that will allow you to save significant money. 

It is very very important that you contact a certified elder law attorney such as myself who can give you advice on those plans, who can walk you through the plan, and also the Medicaid approval process. You mustn’t do everything yourself and you will have assurances it’s being done properly and assets are being preserved for your loved one, your spouse, and the estate. It’s really something that you want to consider and do very promptly.
